DEFINITIONS

Parties - The two parties who are entering into a travel agreement are "Charterer" and "Charter Company."  Charterer - The individual or entity requesting the charter service. Charter Company - The Company providing the service known as Burner Air.

 

GENERAL

All charter quotes are aircraft specific. Should the need arise to change aircraft, cost may vary accordingly. Charterer shall be informed of any such change prior to flight and the amount of additional cost, if any. All quotes are based upon aircraft and crew availability and are valid for 24 hours from the date of initial quotation. Upon acceptance of terms and conditions listed herein, the document provided to the Charterer acts as a legal and binding contract between the two parties.

 

PRICES, PAYMENTS AND CANCELLATION

All prices indicated in charter quotes are accurate on the date quoted, are subject to change without notice, and are valid for 24 hours. The charges and fees indicated are actual prices and will only change if price structure changes before the quote has been completed and signed with billing information within the 24 hour period. Full payment must be due and cleared 24 hours after payment is submitted. All Burner Air flights are non-refundable.

 

DOCUMENTATION

Each passenger must present the following prior to departure: One Valid Photo ID, One Valid Event Ticket, and a boarding pass issued by Burner Air.

 

BAGGAGE AND WEIGHT RESTRICTIONS

Each passenger may bring with them two 25 lb Bags, NOT to exceed the size of a commercial airline carryon. It is the responsibility of each individual passenger to abide by the 25 pound bag weight limit or make arrangements with Charter Company for additional baggage at a $100/bag baggage fee.  Passengers and their baggage will be weighed prior to any flight.  Burner Air reserves the right, without refund, to remove a passenger or their baggage from the flight due to noncompliance with the weight guidelines.

 

ITINERARY CHANGES and TRANSMITTAL OF CHANGES

Itinerary changes are permitted, but subject to aircraft and crew availability and subject to price adjustment. Notification of changes and/or cancellations must be communicated verbally to Burner Air at (844) 733-7444 and transmitted by email to your Burner Air Concierge within the cancellation timeframe listed in your quote.

 

RESPONSIBILITY

Charter Company shall not be liable for any injury, damage, loss, expense, indirect, special or consequential damages, or other irregularity caused by the defect of any vehicle or conveyance, or the negligence of any company or person engaged in conveying the passenger, or carrying out the arrangements for your trip, or by accident, delay, flight schedule, change, cancellation, sickness, weather, strikes, war, quarantine, or any similar cause. Charter Company will not in any event be liable for loss of money, jewelry, cameras, negotiable papers/securities, electronic/video/photographic equipment, heirlooms, antiques, artifacts, works of art, silverware, irreplaceable documents, personal valuables and commercial effects carried on the aircraft. Our liability shall in any case be limited to the amount paid to us, and any claim shall be adjudicated in and governed by the laws of the State of Nevada in which we have our principal business location.

 

PARTIAL COMPLETION OF FLIGHTS

Charter Company is not liable for expenses incurred for replacement transportation in the case of mechanical disruption or delay, (in such cases our charges apply only on portions of flight completed). If a flight does not reach its destination due to weather, charges apply to any destination reached and return flight of the aircraft and crew (with or without passengers) to home base. In the case of mechanicals, or unavailability of aircraft type, Charter Company may at its option provide substitute transportation which shall be charged as an additional fee to charterer. In such cases Charter Company's original charges apply only on portions of flight completed.

 

DELAYS OR CANCELLATIONS:

Delays or cancellations of flights due to weather, mechanicals, or landing conditions are not the responsibility of the Charter Company.  All reasonable efforts will be taken to uphold and complete flight leg once the situation has improved.  If delays or cancellation are the responsibility of the Charterer the Charter Company holds the right to proceed with any other passengers to finalize flight leg.  The Charter Company holds the right to put the negligent Charterer on a “wait list” for another flight or the Charterer can pay additional funds for another flight to be organized by the Charter Company.

 

OPERATIONAL

Charter Company is not a direct or indirect air carrier. All flights arranged by Charter Company use FAA certified and DOT licensed air carriers that exercise operational control over the flights. Charter Company arranges flights either as an agent for its customer or the air carrier. Charter Company is not affiliated with the Burning Man Organization and is a privately owned and operated company.
